You need to file for divorce and get the question resolved in that legal proceeding. It is unlikely that the loan company will ever let you off the loan unless your wife completely refinances in her own name.

Spouse support

Stephen Marc Drucker

The spousal support award is dependent on a variety of factors. Some of these factors are the differential in income, length of marriage, education, health and other factors. When you file for divorce, you may also file a Request for Order for temporary support while the divorce is in progress. For temporary support, only differential in income and need are factors. In the trial phase, a permanent order would be addressed. It is important to note that if your spouse contributed to a retirement fund during the marriage (from the date of marriage to the date of separation) you may be entitled to a portion of it.

Probably not. Usually large settlements in divorce is splitting up the property. Those payments are not taxable. Only alimony payments are taxable to the recipient and deductible to the payor.
