If my husband cashed in his 401k which was accumulated during our marriage, how does it get handled during equitable distribution?

If he cashed out the 401K while you were still married and not separated, it depends on what he did with the money. If he took all the money and is hiding it or bought a house in Jamaica, you still get your share back from him in some form, or you could, as a penalty to him, get 100% of the asset back because of his misuse and abuse. This could also apply if he took all the money out after you separated, as you're supposed to get 1/2 of the 401K. It could be given to you in equivalent value from some other asset, for instance. Call a family law attorney and discuss how this works.

Why bother to seek a separation if what you really want is a divorce? The documents and the expense are about the same. However, first things first: consult an experienced family law attorney. It's almost always worth the investment. He or she can advise and represent you, draft the various papers, and generally keep things going as smoothly as can be. The process for obtaining a legal separation is like a divorce: your lawyer drafts up a summons and petition, often along with a Motion for a temporary order, files them with the Court, and has then served (officially delivered) to your spouse. If there is a temporary order required, s/he can obtain a hearing on fairly short order.

If your parents are buying the vehicle, and you have it titled in your name only , it would not be a marital asset it would be your separate property.  Only if you put marital funds (money) toward the purchase or trade in a marital vehicle, would this new vehicle be marital subject to equitable distribution. The theory is that a gift comes from an outside source and did not involve use of marital funds to purchase it.  As long as you dont put your spouses name on it (called comingling) the it remains your separate property.
