What will now happen on the home equity loan?

Your fact statement is a bit difficult to unravel in terms of separate and community property. Separate property is owned prior to the marriage and community property is acquired during the marriage. The court cannot award separate property to the other spouse. If you owned the house prior to this marriage, it is your separate property. With respect to the equity loan, the creditor will sue the parties who signed the note. I suggest you hire a lawyer.

Can I re-file that same case, since we filed without prejudice, or is there a time limit for that?

Without prejudice means that you can file again. If it had been "with prejudice" you can't file again. But, no one can really enforce "with prejudice" in divorce cases because the US Constitution provides that we all have freedom of association rights. To answer your question: You can file again but you cannot use the case number from the prior case. It will be a new case number. Good luck.

If we divorce now, can I still get my green card? How?

If you divorce before then, there will be no marriage to support an approval. If it is dangerous to wait, you may want to consider a separate petition under the Violence Against Women Act (VAWA).
