You have not stated which 'divorce papers' you mean. If the document you are thinking of is a Marital Settlement Agreement which he won't sign, a good way to move things off dead center is to ask the Court for a pre-trial conference, to determine the issues which are contested, and to schedule a trial. That usually gets things moving.

If my wife lives in one state and I live in another state and we were married in a different state, how would we be able to get a divorce?

If there are children involved, the divorce action should be filed where the children reside. If there are no minor children, either party can file for a divorce in a state where they meet the residency requirements, or they can file in the state where the spouse meets residency requirements. If you cannot agree on where the divorce should be filed, the court would consider whether either spouse has lived in the other state during the marriage, or where the acts giving rise to the divorce took place.

If he throws your things out call the police. That is your home and even if the house was his before you got married, you have an interest in it for payments made on it during the marriage. You might want to file for a restraining order at your local court before he does anything as dramatic as throwing you and your son out of the house. It all sounds very dangerous.
