Can I appeal my divorce decree after 2 years?

Cathy Rose Cook
Answered by attorney Cathy Rose Cook (Unclaimed Profile)
Divorce lawyer at Cathy R. Cook, Attorney at Law
You only have 30 days to appeal a divorce decree. If you can show fraud or that your spouse hid assets, you can file a motion to set aside the decree. You would need to consult with a local attorney to see if you have any chance at this.

You can obtain the necessary forms from the clerk of court to file a standard petition for dissolution of marriage with no children. You can file this without your wife's signature, and you will then need to send her the appropriate waiver to sign and return to you. There is a self help office at most courts where a lawyer can show you how to complete the forms.  You will need to complete a financial affidavit as well.
