My wife is seeking a divorce which i have no problem with however her grounds are Adultery which I have not. we have no children and we live together

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Thank you for your question, I will be happy to assist. Adultery is grounds for divorce in NJ, however, it will not impact the overall outcome of the distribution of marital property unless there were dissipation of assets that benefited the adulterous relationship. At the end of the day, the divorce can still be granted for adultery, but your property will still be equitably distributed. It would be wise to contact an experienced family law attorney to answer any specific questions that you may have.

Can I just leave my home and come back to get my child back

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
Leaving your house may affect your ability to get custody in the future.  Even if you leave the house, you must make sure that you stay in touch with your son, regularly visit, stay active in his life and be sure that he knows how to get in touch with you at all times.  You do not want a claim that you "abandoned" him or that you are and unfit mother.  You may also be able to do a pro se (without a lawyer) application to decide custody and/or visitation before you leave, or just after you leave.  The New Jersey Judiciary website has pro se packets available on line.  Scroll all the way to the bottom and look through the paperwork and see if there is something that you can file before you file for divorce that wold give you support, and custody.  Its called pendente lite relief.  Good luck.

If parents reconcile after divorce, and then things go bad again, will the father owe back child support/alimony from when they were reconciled?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
It is possible that you will technically owe support and allimony, but if all the parties were living together under the same roof, you can apply to the court to have that waived as not being applicable.  you should have proof as to the dates on which everyone was back together and when child support/alimony should start again.
