How can I preemptively be prepared for a divorce if I feel my spouse is up to something?

Answered by attorney Sabina Tomshinsky
Divorce lawyer at Home Town Law, P.A.
You really need to have an in-office consultation with a divorce attorney in your area as to all of your options and whether you should file first or counter when/if your husband files. In the meantime, I would make a list of all your tangible and intangible personal property, real property, their FMV, if known, list of liabilities, if any. I would also think about the parenting plan provisions that you would want to propose. In Florida, both parties are also required to comply with the mandatory disclosure rule; therefore, it would be prudent to start collecting all those documents that must be produced per the disclosure.

What are the procedures on getting an annulment under six months?

Answered by attorney Monica H. Donaldson Stewart
Divorce lawyer at Donaldson Stewart, P.C.
The length of the marriage has nothing to do with whether you can seek an annulment. A marriage can only be annulled if there was a legal flaw at the time the marriage was entered into. If the marriage was validly entered into, and then a change in circumstances causes you to no longer want to be married, then you would have to seek a divorce, not an annulment. Since Arizona is a no-fault state, the reason for the divorce (e.g. infidelity) is irrelevant.

After an unused retainer is refunded to the client, can a law firm bill the client again asking for additional money?

Answered by attorney Erin Patricia Farley (Unclaimed Profile)
Divorce lawyer at Law Office of Erin Farley
Attorneys are people, and everyone makes mistakes. There are occasions where bills for costs come in after representation has ceased; for example, an additional bill for reporter costs for a deposition, etc. The action is not unlawful, but any additional requests for money should spell out the exact nature of the mistake and the amount at issue. The amount of time between the end of your representation and return of the retainer is concerning. If you dispute the bill, call your local bar association and inquire about their fee arbitration program.
