Yes, you can ask your wife to sign a deed giving all her interest in the house to you. It does not sound like she will be contesting the divorce, so it could go smoothly. What county are you in?

What will I be entitled to in a divorce if we have a prenup?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
Does the prenup say that you get of everything in a divorce or if he dies? If the former, you need to divorce him and get your money now. If it says you get that if he dies, then you have a conflict with the will and that may cause problems for everybody. You should contact the Idaho State Bar and get a referral so that you know what to do.

Am I entitled to part of my home in a divorce?

default-avatar
Answered by attorney Rian F. Ankerholz (Unclaimed Profile)
Divorce lawyer at Ankerholz & Smith
In Kansas, the name of the owner on the deed does control the final disposition of the property. Kansas is an equitable property state, and the trial court can divide property as deemed fair. Because you contributed value to the house, it is likely you will be awarded some equity. Other factors may apply, such as premarital agreement terms. Consult an experienced family law attorney in your area.
