My wife filed for divorce in NJ 5 months after we moved to VA, Now she is trying to dismiss on the grounds that the divorce request was never valid.

Answered by attorney David Salvaggio
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Unfortunately, your wife is right. When she filed for divorce in New Jersey, neither one of you was a bona fide resident of New Jersey. Therefore, New Jersey did not have jurisdiction of the divorce case. If you moved to Virginia in August 2012 and still live there, you should contact a divorce lawyer in Virginia, because you ought to be able to seek a divorce there and get all of your issues resolved.

Am I entitled to my husband's land even if there is a quitclaim already?

It is essential that you consult with an experienced family law attorney in your area to review these facts. When you do bring with you whatever documentation you can, copies of deeds, county tax bills, tax returns, etc., so the attorney can properly advise you. From the general information you provide, and your facts, this real property generally appears to be community property which must be divided by the court.

Do all assets become half owned by your spouse after marriage?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
Assets that were acquired AND paid for prior to the marriage are non-marital unless you add your spouses name to the title or deed. Debts owed prior to the marriage are non-marital. Any asset that is acquire or debt that is incurred during the marriage is marital regardless of whose name it is in. The best way to protect yourself is to enter into a prenuptial agreement wherein you clearly define who has what, how joint assets are defined, etc. in the event of a subsequent divorce.
