Can a parent move back to home state with the minor children to file for divorce?

Answered by attorney J. Allen Fiorletta
Divorce lawyer at The Fiorletta Law Group, PLLC
Dad can move to a different state, resde there the required length of time to satisfy jurisdictional requirements, and file. Taking the minor children with him, however, would not be advised. That could lead to serious ramifications.

Yes. For a number of reasons, it is better to wait if you are sure you want to file but it is close to 10 years.
