You need to file for a divorce and ask for child support and alimony.. He has a legal duty to support your child..if you cannot afford an attorney you need to contact legal aid in the city where you are living. At worst case depending upon where you are at Google "womens shelters in ____ city" and contact them.

I would suggest you speak with an attorney, in Michigan and I assume most other states, once a divorce or order of legal separation has been filed the ability to continue to cover the ex spouse or separated spouse on an employment-based medical insurance program terminates. You should also discuss with an attorney about your anticipated payout from his pension, which normally in a divorce would only cover those years you are actually married.

If your soon-to-be ex files the Complaint for Divorce as the Plaintiff, and if you amicably resolve all the issues of the case, it is possible for you to avoid going before the Judge, but your spouse will have to, in order to present "proofs" to the Court to facilitate entry of a final Judgment of Divorce.
