Yes, really. The three elements are agreement that you are married, cohabitation and holding yourselves out in the community as married. The fact that there are no documents or writings proving any of these elements does not prevent a court from finding a common law marriage if there are other kinds of evidence. Even oral testimony alone is enough if the judge (or jury) believes it.

Absolutely do not sign anything! Go see a lawyer in your community to protect your rights. You are entitled to one-half of everything earned in the retirement account during your marriage. Again, do not hesitate to talk to lawyer. You stand to lose a great deal.

If signatures were required from a spouse in order to get divorced, then that would give one spouse dominion over the other in perpetuity. Slavery was outlawed, so no. This is no different than forcing someone to a trial who denies any wrongdoing.
