Will I be entitled to alimony, spousal support and half of my husband's pension?

Annette M Cox Sandoval
Answered by attorney Annette M Cox Sandoval (Unclaimed Profile)
Divorce lawyer at Cox Sandoval Law, PLLC
Arizona is a community property state so assets and debts accrued during the marriage require equitable (usually equal) division. Spousal maintenance however is dependent upon many factors such as length of marriage; financial disparity between the parties; your earning potential upon divorce and what sacrifices of your career were done to benefit the marriage or enhance his career. I would suggest contacting an attorney to discuss your case in detail.

Does my ex have any claim to my home if I am paying the mortgage?

Answered by attorney Barbara Peyton (Unclaimed Profile)

The answer to your question depends on where the money came from (and comes from) that you use to pay the mortgage. If it comes from your earnings during marriage (regardless of a separate account) husband is entitled to reimbursement of one-half of all payments made to your mother. If the money came from a separate property source (ie, money you had before marriage, inheritance, etc) then he is not entitled to reimbursement On these kinds of issues you will probably need a lawyer.

Can I withdraw my 401k without her signature if I have bifurcation status divorce?

No that only deals with being single instead of married. It sounds like the property division has not yet been done. There are automatic temporary restraining orders in effect until each asset/debt is disposed of, so you would be in violation of the restraining orders.
