Even if your marriage was performed in a foreign country, you can obtain a Dissolution of that foreign marriage in the United States. A "legal separation" is not a dissolution of the first marriage. A marriage to another while you are still legally married is illegal, and renders the second marriage void.

I still cannot understand your question totally, but an action can be dismissed by a failure to serve the summons and therefore its expiring, or can be dismissed for no progress by the Court. Without reviewing the file it is impossible, on the facts you provided, to give you detailed advice. The file in the courthouse would have to be reviewed. Read over carefully whatever documents you have in front of you, you may find that your answer is on them.
