Just got served divorce papers how do i respond

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Once served with a Complaint for Divorce, you have 35 days to file an Answer, Counterclaim or Appearance.  Because your husband filed in Passaic County, that is the venue for the divorce proceedings.  You will need to file your Answer, Counterclaim or Appearance with the Court in Passaic County.  Review the Summons carefully.  The address of the Court where you need to file your responsive pleadings should be listed on the Summons. The attorneys at Weinberger Law Group offer a free one-hour initial consultation.  We are available to review the Complaint for Divorce with you, explain the divorce process and discuss your next steps.  We can also discuss with you options for requesting that your case be transferred to a different venue if Passaic County is not the appropriate venue.  Call today to schedule your consultation - (844) 260-4133.

Am I entitled to divorce alimony?

default-avatar
Answered by attorney Mark Alan Brown (Unclaimed Profile)
Divorce lawyer at Wolfstone, Panchot & Bloch, P.S., Inc.
Alimony is called "Spousal Maintenance" under Washington law. The governing statue is RCW 26.09.090 which directs the court to consider the following factors in determining whether and to what extent maintenance shall be awarded. The length of the marriage is only one factor. 1.The financial resources of the party requesting maintenance after the divorce depending on other assets awarded, etc 2. The proposed vocational/educational plan of the party requesting maintenance 3.The standard of living established during the marriage 4. the duration of the marriage (the duration of the pre-marital relationship is not enumerated in the statute; but in my experience some judges will consider that as well) 5.The age, physical condition and emotional condition of the party requesting maintenance 6. The financial resources and ability to pay of the other spouse after the divorce depending on earning capacity, other assets awarded, etc.

What can I do if my husband from overseas refuses to sign the divorce papers?

default-avatar
Answered by attorney Andrew Elliot Teitelman (Unclaimed Profile)
Divorce lawyer at Law Office of Andrew E. Teitelman
It really depends on the circumstances for which your husband is overseas. If he is in active military service, there may be a potential delay to proceeding with the divorce due to the Civil Service Relief Act. If he is not, then proceeding with a request for a default after the time allotted for her his response to the petition for dissolution has passed would be an appropriate avenue to explore.
