How fast can I get a divorce if my husband and I live in two different states?

David M. Rich
Answered by attorney David M. Rich (Unclaimed Profile)
Divorce lawyer at Flatiron Legal Advisors LLC
The fastest you can get divorced in Colorado is 91 days after he is served with the petition for dissolution of marriage. The fact that he is in Georgia does not make a difference. However, to be finished in 91 days will require his cooperation. If he does not cooperate to get his financials filed and sign a separation agreement and couple other steps, it can drag on (generally no more than 6 months though in a case like yours). A lawyer can be helpful in cases like this by knowing the process and keeping the process moving forward to get you done as soon as possible.

How do I claim my portion of my ex husbands retirement?

default-avatar
Answered by attorney Yahima Suarez (Unclaimed Profile)
Divorce lawyer at Hernandez & Suarez, PL
To be able to obtain entitlement to the retirement of your, what seems now ex-husband, you must draft and submit to the retirement company a QDRO, Qualified Domestic Relations Order. This is an Order that a lay person is not recommended to prepare, in fact, many attorneys do not draft these orders. But, one must be prepared and submitted to the retirement company so when you become entitled to the funds, when your husband or ex-husband retires, you can receive your share. The information above is for informational purposes only and shall not be construed as legal advice.

Is it considered abandonment if Husband left the home, after his mistress called and sent emails about their 3-year relationship?

default-avatar
Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
The primary reason anyone is ever asked to leave the home is physical or emotional domestic violence. It may be that your husband thinks it would be better for all concerned if he left the house. You should probably talk to a family law attorney in your county to protect your rights.
