I still cannot understand your question totally, but an action can be dismissed by a failure to serve the summons and therefore its expiring, or can be dismissed for no progress by the Court. Without reviewing the file it is impossible, on the facts you provided, to give you detailed advice. The file in the courthouse would have to be reviewed. Read over carefully whatever documents you have in front of you, you may find that your answer is on them.

It depends. Each firm sets their own fees. I would say between $1200 and $1500 to be sure it is done right as long as there are only minimal property and support issues to be included even though uncontested.

There seems to be a kind of myth floating around that if a spouse 'abandons' the family home, they give up their ownership rights. Not so. If you are on the deed to the house, you own it, along with whomever else is on the deed. Consult an experienced divorce lawyer. It's almost always worth the investment.
