Michigan is a no fault divorce state..therefore she cannot be forced to stay married and eventually she will get a divorce. Further, if the children are willing to testify most likely she will eventually get custody. Unfortunately divorces, and divorce attorneys, can be expensive when one spouse does not want the divorce. Regardless she needs an attorney. Hopefully she can force her soon to be ex to pay her fees.

Colorado law provides an unused marriage license expires if not used in 35 days after it issued. The facts you describe suggest that nothing happened in that time period that would show a marriage occurred. So, it does not appear you were ever married.

Any part of the 401k that accrued during the marriage is community property. Protecting it is more about the length of the marriage and if the other side is claiming a community portion, you may be able to offset the amount with some other asset or a cash buyout. You should consult with an attorney.
