Texas is a community property state. This means that the income that either of you makes from any source belongs to you both jointly. Unfortunately, this also means that creditors can seek payment from either one of you for debts. It may be a good idea to talk to a divorce lawyer about a post-marital agreement, dividing your assets and debts to protect you from your husband's financial troubles. A post marital agreement is a document that you and your husband can execute that essentially removes the presumption of community property and isolates certain assets and liabilities as separate property.

You would be entitled to spousal support until you can become self-supporting. In your case you would likely be expected to support yourself with-in one year. Your marriage is considered short term. Spousal support is not forever. You will be expected to get a driver's license if you can qualify to get one. The court will likely inquire as to why the father of your children is not paying child support. You will be expected by the court to find a job. Your current husband would have no duty to pay child support. You should have the Department of Child Support Services chase down the children's father and collect funds for support and for child care so you can work.
