If your husband does not want to sponsor you for green card, you will have to do it yourself. Based on your question, you may be eligible for cancellation of removal, which requires you to have lived in the US for ten years, good morale character and if you can show your deportation would cause extreme and unusual hardship to your USC children. California will recognize the marriage as valid if Mexico recognizes it as valid. You may want to have proof available such as certificates, etc. You would have more of an issue if you have no documentation of the marriage and your husband decides to claim that there was never a marriage. Otherwise, you should receive the same treatment, protections, and benefits under California law.
