If you get a divorce he will be responsible for his debts from the date the dissolution is ordered. Until that date you can be responsible for his basic needs such as food, rent and medical. The medical can be highly expensive. A separation will not stop your liability for those debts. In addition if you share joint credit accounts you can be held responsible by the creditor.? You need to end all joint credit cards.

In California, there is a rebuttable presumption that if an ex spouse receiving support is living in a romantic relationship with someone else, that there is a reduced need for support. You should consult an experienced family law attorney in your area.

The issue here would be residency requirements.  If you and your spouse filed your tax return in Texas then you would be a resident of Texas and could file for divorce or legal separation there. However, if you choose to move to CA, then you would need 6 months in the state and 3 months in the county in order to file in that county.  You should speak with an attorney in Texas before you move so you understand your rights there.
