Does gifts from parents become marital property that the husband or wife must share with each other?

default-avatar
Answered by attorney Mark Alan Brown (Unclaimed Profile)
Divorce lawyer at Wolfstone, Panchot & Bloch, P.S., Inc.
That depends on to whom the gift is made. Under Washington community property law, if the gift is made to one spouse; the gift is the separate property of that spouse. If the gift is made to both spouses, then it is the property of both spouses. Whether made to one or both depends on the facts (e.g., a gift letter to "John & Mary" or just to "John").

What steps do I need to take prior to divorce to make sure that I will be ok financially?

Stephen Marc Drucker
Answered by attorney Stephen Marc Drucker (Unclaimed Profile)
Divorce lawyer at Legal Action Workshop Professional Corporation
First, if you need to remain on your spouse's health insurance then you will need a Legal Separation which will address all issues but in the end will not be a divorce & hence will not allow either party to remarry. The best advice is to get advice that is based on your specific situation i.e. the number of years married, amount & type of assets, child issues and amount of debt.  There may also be other issues. An experienced attorney (like our law firm) can explain spousal support (& child support if you have children) as well as address the issues so you have a good idea of the possible outcome.  The best Legal Separation or Divorce is one in which the parties can agree on all issues and do not have to fight in court as this is costly.

Are prenuptial agreements binding?

default-avatar
Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
Prenupturals are generally binding.. if done right and all appropriate disclosures are madeHOWEVER a court should not leave you without income if you substantially changed your potential income because your husband wanted you to stop working once you got married.
