Can I file an adultery charge to contest a divorce and send a subpoena to the third party?

You can file for a divorce. Adultery is not a ground for divorce in California. We are a no fault state so the only real ground you can state on the paper work is adultery. People's sex lives are not relevant to divorce cases so you would probably not be allowed to force your wife to give up the boy friend's name.

If a couple have lived a fairly equal life monetarily, how should the financier be distributed

Whose name a particular item is held in is not usually relevant to determining how the asset is to be divided in a divorce. With narrow exceptions (premarital property, inheritance, gift to an individual, award in a personal injury lawsuit) the question is whether the asset was obtained during the marriage, which is defined as from the date of marriage to the date of the first filing for divorce. Whether you earned approximately the same amount during the marriage is also generally irrelevant when it comes to a discussion of equitable distribution.

Stephanie Elizabeth Emanuel

Hey Cindy, thanks for reaching out regarding your daughter. I understand how concern you must be. Divorce is a tough thing to experience, however working with the right counsel can make a lot a difference. We always try to mitigate the issues to ensure a quick, simple divorce without arguments.  Child Custody is what your daughter will be entitled to, and please children comes first. Fight for custody and we represent both the child and the parent. As far as assets are concerned, we can go over the details of what and how much to go after once we are retained to go over all the available options, regarding custody, house, and any assets, and benefits. Feel free to contact my office and speak with my case manager at 1 877-866-8665 to discuss in more details regarding this case. Thank you.
