Can i change property settlement agreemet after divorce?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You usually do not change the property settlement agreement (PSA) after the divorce.  If there is a change in circumstances that gives rise to a cause of action for a change in alimony or child support, then that part of the judgment of divorce is modified, but not usually the poperty settlement agreement.  Unless you discover assets or debts that were not considered at the time you signed the PSA.

My son is a Coast Guard vet tho is going through a divorce and has run otut of money. Are there any pro bono options available to him

Answered by attorney Diana L. Anderson

It depends what he needs to do.  There are free forms available on the New Jersey Judiciary website that will allow someone to file for a divorce without an attorney.  If he is in the middle of the divorce, then he can still represent himself.

Can I make a large purchase after I filed for divorce without sharing the purchase with my husband?

Answered by attorney Brent R. Chipman
Divorce lawyer at Law Office of Brent R. Chipman
It depends on whether or not you use your own funds for the purchase, and also if by using the funds for the purchase, you deprive the other spouse of marital assets that should have been used for their support. One way to avoid the problem is to wait until the decree is entered to make the purchase, or to minimize the amount of any down payment for the purchase. A large purchase on credit does not provide an asset with any worth for the court to divide.
