What procedures do I need to take, if I got a marriage license with someone that was already married?

Answered by attorney Jacob Schwab Ginsberg (Unclaimed Profile)
Divorce lawyer at Ginsberg & Associates
You need to file for annulment of the marriage. Annulments are different than a divorce because you have to prove fraud. That should not be difficult if he told you he was single when he married you.

What can I do if Spouse refuses to sign divorce papers?

default-avatar
Answered by attorney Eric J Trabin (Unclaimed Profile)
Divorce lawyer at The Trabin Law Firm, P.L.
If spouse refuses to stipulate to the divorce then simply go forward without him. File a petition for dissolution of marriage and have him served. Initiate the divorce and set the case for mediation. If the case resolves at mediation, great. If it doesn't, the case can continue to be litigated. Ultimately, if the spouse won't agree then the judge can make the final decision.

Am I entitled to part of my home in a divorce?

default-avatar
Answered by attorney Violet Ikeanyi Nwokoye (Unclaimed Profile)
Divorce lawyer at The Nwokoye Law Firm
If the home was bought during marriage, then it is presumed a community property and thus 50/50 absent any evidence to the contrary. If the home was bought before marriage, it is presumed a separate property absent any evidence to the contrary. Separate properties can be subject to findings requiring the spouse owner to reimbursement the community estate or the other spouse of any contribution to its improvement and or increases in value. You maybe entitled to some value in the property depending on which facts apply in your situation.
