How can I get my ex to follow court order and pay me?

Answered by attorney Barbara Peyton (Unclaimed Profile)

If he is self employed you have a problem because the only asset you can levy on is any known bank account. If he is employed, get the court to give you an order to levy on his wages. Bankruptcy does not relieve him of his obligation to pay support.

Husband has been gone 8 years and i can't find him to sign the divorce papers . can i still divorce him

Answered by attorney Ronda Elizabeth Harris
Divorce lawyer at Harris Law Firm, PLLC
Yes, you can file for a divorce by publication.      Divorce by publication happens only after a judge has been convinced, based on a sworn declaration, of the serving party's inability to find the Defendant after a "diligent search." Service by publication is commonly used in a divorce action to serve a spouse who has disappeared without a leaving a forwarding address. In Texas, divorce by publication is not an easy route to go. Divorce by publication has more steps, is more complicated, and is more expensive than an agreed divorce. In short, it is easier and cheaper if you can find your spouse and get them to sign off on the final divorce decree, but you can still get divorced.

Does the petitioner in a divorce have to be at the court hearing or can someone with Power of Attorney go in their place?

Robert Jensen 'Bob' Matlock
Answered by attorney Robert Jensen 'Bob' Matlock (Unclaimed Profile)
Divorce lawyer at Mackoy, Hernandez, Jones and Woods LLP
A power of attorney does not give you permission to testify as to facts known to your son. There are federal and state statutes that relieve military personnel from court appearances due to their service obligations. I suggest you hire a lawyer.
