How long do I have to pay spousal support for?

Answered by attorney John E. Kirchner (Unclaimed Profile)

There is no simple rule. The duration of spousal support following dissolution of the marriage is a matter for the judge's discretion if you and your wife cannot agree on a reasonable period of time needed for her to become self-sufficient. There are many different factors that must be considered in making that decision, so you should consult an attorney who can assist you in identifying the most significant facts that would probably influence what a judge would do.

How many years of marriage to be entitled for pension?

Answered by attorney Jessica M Cotter (Unclaimed Profile)
Divorce lawyer at The Law Firm of Jessica M. Cotter, P.L.L.C.
The portion of a pension that constitutes community property would be the amount earned during the marriage. Each party would be entitled to one half of the portion of the pension earned during the marriage. The pension earned prior to the marriage is the separate property of the spouse who earned the pension, and not subject to division.

You really discuss this with your attorney when the case comes to settlement. You may be eligible for alimony from which you can buy a car.
