I live in NJ. My husband purchased the house less then 1 month before we got married. Is this considered marital property and will it be divided

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You may be entitled to a portion of the increase in value of the house form the time of purchase to the time of divorce.  If you are paying towards the utility bills (gas, water electric) you may not have any recourse. But if you are contributing to the mortgage, you may be able to claim entitlement to a portion of the equity in the house.  The more important issue is the way you are both dealing with money - it is the number 1 reason couples fight - see a counselor before things get too far out of control !

What legal issues could I face if I accept and sign divorce papers under suspected adultery?

I do not think it matters. At the end of the day, a divorce is much mire akin to dissolving a business than adjudicating moral issues.

How long do I have to pay alimony in NJ

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
How long you have to pay alimony is made up of a few different factors like how much each party earned, or is earning, how long was the marriage, are there children, etc.  Sometimes there is limited duration alimony like only a few years, if the marriage was short and both parties have earning potential there might not be any alimony.  Also you can negotiate a deal to divide assets in a certain was to avoid any alimony.
