Do I get alimony in my divorce if I am a stay at home mom?

Richard B. Jacobson
Answered by attorney Richard B. Jacobson (Unclaimed Profile)
Divorce lawyer at Richard B. Jacobson Associates, LLC
Alimony, or as it's now called, maintenance, is determined by many factors (10 or 12 in Wisconsin). Your having been out of the labor market for ten years or so is definitely one of the factors. Some others are you skill and training, how the assets of the spouses are divided, what time it would take for you to acquire training to compete on the job market, and others. Discuss this with an experienced matrimonial lawyer. It's almost always worth the investment. Good Luck.

Is there a difference between Motion to Modify a Spousal Support and a Motion to Change Spousal Support?

Steven Palme'
Answered by attorney Steven Palme' (Unclaimed Profile)
Divorce lawyer at Palme Law Firm, P.A.
There is no difference. The usual legal term is modify. Change is a synonym for modify and it would be treated the same. Once you file a motion to modify alimony, the Court is able to make whatever modification it feels necessary based on the evidence presented?modifying the amount either up or down based on the change in circumstances. It is possible that the modification can be to reduce alimony to 0 if the circumstances warrant it.

Can my attorney withhold divorce decree for non-payment?

Answered by attorney Vanessa J. Gorden
Divorce lawyer at GordenLaw, LLC
She can't "withhold" it but she also does not have to go to the work and expense of procuring it for you if she believes you owe her or her firm money. You can go to the clerk of the District Court where your divorce was finalized and purchase your own certified copy for a fairly nominal fee. As to the unpaid amounts, I would suggest that you talk with your attorney directly and ask for an accounting, itemized of how the charges were incurred. Often court dates are moved and rescheduled because of the court or procedural things that are not the attorney's fault, but she still had to spend time dealing with those issues. She may very well have been working behind the scenes for you and earned that amount, but you will want to ask her to explain what she was doing.
