Do I need to pay to transfer my case files

John Michael Frick
Answered by attorney John Michael Frick (Unclaimed Profile)
Divorce lawyer at Reid Dennis Frick, PC
As a general rule, a lawyer cannot charge s $300 "transfer fee" for transferring your file to a new attorney.  He would only be able to bill you for the actual time he or his staff expended in gathering your file together, physically or electronically, and then delivering them to your new attorney.

How can I file for divorce if my husband is in prison in another state?

Kimberly Demetrice French
Answered by attorney Kimberly Demetrice French (Unclaimed Profile)
Divorce lawyer at Law Offices of Kimberly D. Moss, PLLC
If you live in Texas, you can file for divorce where you live and attempt to have your husband served at the correctional facility where he lives. If this doesn't work, you will need to ask the Court for permission to serve him by alternative means (by posting notice at the courthouse or in the newspaper). You would do well to hire an attorney to help you because your husband is incarcerated and may be difficult to obtain personal service on. You're welcome to contact my office for a phone consultation to discuss your case.

Can DES do a DNA test without my knowledge or consent?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
I think your ex-husband is blowing smoke. If he does not think that he is the father, he can ask the court to order a DNA test. The way to prove the lie is to ask the court to hold him in contempt for not paying the child support. If he has the ability to pay, a court will likely hold him in contempt. If he is unemployed, the court will probably not hold him in contempt because he does not have the ability to pay.
