First, if your attorney filed and served the petition and your husband failed to respond, you can get a default judgment at this point, which would end the marriage. Second, a divorce does not involve any charges or guilt. The purpose of discovery is primarily to determine assets and debts. If you believe your attorney has not done the work promised, you can call the bar association fee dispute program and set up a meeting. They will then meet with you and your attorney to determine what the fair amount of payment is and you will be refunded anything that was charged beyond what was appropriate.

If either party violates they can be criminally prosecuted. The cases are dismissed when the petitioner does not show up for the hearing and present sufficient evidence that a permanent injunction needs to be entered

I can answer the first question. You have to be a resident of Wisconsin and of the county where you file the divorce for a certain period of time when you start the divorce. You do not necessarily need to stay in the U.S. However, negotiting the terms, especially if the divorce is contested, can be very cumbersome if you are living outside the U.S., As to green cards, I think you must consult an immigration lawyer.
