You father needs to sign a will and power of attorney immediately. If he does not do his estate planning, his wife will get her statutory share. He can sign a handwritten will but it must be witnessed and should be notarized. Best he gets a trust done to avoid probate fees as he has a house.

Your husband can file for divorce in New York and make the claim she took the child against his consent and has refused any contact. You need to hire an attorney in New York, the fact they are not divorced is in his favor as far as getting the child back, what she has done could be considered parental abduction and aside from filing criminal charges taking the child from her is a remedy courts often order.

I can only offer advice about cases in California. I am not licensed in Virginia. In order to file a divorce (dissolution of marriage) case in California, one or both of you must first reside here for six months before filing. Under California law, you could serve the person outside the U.S., but you may have to follow local laws there. I can't offer more information unless you qualify for filing a California divorce or one is already on file here.
