It doesn't matter who files first. There is no "blame" in California family law so each side has rights and duties and it doesn't matter who is called Petitioner or Respondent.

No it will not be enough. You both need to appear before a judge and get a court order. The two of you need to go to a paralegal to get the documents drafted which will protect both of you. Paralegal are far less expensive than an attorney and a good family law paralegal can efficiently prepare all your documents for you.
