If you're in Texas you should act quickly, because every month that passes before your retirement gives her a bigger portion of your retirement rights. She may not get spousal support, but she's likely to get an award of retired pay. But DFAS won't withhold her portion of the retired pay and send it direct to her unless you were married for at least 10 years of service. See a lawyer. Good luck.

First, the obvious: threats are both easy to make and foolish. Under the facts you describe the business and its assets are marital property. The appropriate way to handle this is to file for divorce quickly so that anything he does to damage the business is charged against his side in the equitable distribution. You should retain a local divorce lawyer and get to work - filing, by the way, is in Supreme, not Family Court.
