Can my ex husband get alimony?

Answered by attorney Diana L. Anderson
Divorce lawyer at Diana L. Anderson
You really can't waive child support and you actually did not but you might have signed something that indicated if you applied to the court for an increase or for child support he had the right to apply for alimony.  Based on the length of your marriage and the salaries, he may not be entitled to alimony.  Even if he is, it would be for a very limited time.  The potential child support would outweigh the risk of alimony.

What happens during divorce if I buy a house in the course of our marriage, and he didn't contribute anything both for purchase or mortgage.

Answered by attorney Bari Zell Weinberger
Divorce lawyer at Weinberger Divorce Family Law Group, LLC
Thank you for your question. I am sorry that you find yourself in a confusing situation. Generally, assets that are obtained during the marriage that are not from a third party gift or inheritance or from pre-marital monies, would be subject to being divided between the parties. However, more information would be required to evaluate your particular circumstance. I would recommend that you consult with an experienced divorce attorney to ensure you are fully aware of your rights and responsibilities.

In New Jersey, she might be subject to permanent alimony, child support and pending the end of the litigation, she would be responsible for spousal support which could mean paying the mortgage as well as pay child support.
