In Ohio, we are an equitable distribution state; Your spouse is entitled to one-half of your retirement earned during the course of the marriage; In order to determine what that amount would be, you would have the get what is called a Qualified Domestic Order (QDR) done; Sometimes the retirement plan will provide the necessary documents and compute the value for a fixed fee, otherwise you either have to have a lawyer do it or find a company that specializes in them

If my daughter signed a lease agreement and is filing for divorce does she need to submit a formal eviction notice to her spouse to move him out

Since they are married, your daughter should get a temporary order with a move-out date for the husband. In eviction court, he could just say he's her husband and the judge won't have jurisdiction to evict him. This is a family law matter that should be handled in family court.

Generally, an attorney will represent one party to the divorce but not both.  That said, some attorneys are willing to draft the decree based on the instructions of the parties.   Based on your inquiry, it appears you will need a divorce decree and documents regarding the real property (i.e., special warranty deed, deed of trust to secure assumption, etc.).   I think you have 2 choices:   1)  One of you hires an attorney who then drafts the final decree of divorce and the real estate related documents.  2)  You both hire an attorney to draft the documents based on your agreement(s).   The down side to option 2 is that the drafting attorney is essentially only a secretary drafting the documents and cannot give either of you legal advice.
