Can I stop paying for my ex-wife's bills and child support?

Rebecca A Rainwater
Answered by attorney Rebecca A Rainwater (Unclaimed Profile)
Divorce lawyer at Landon Rainwater Robinson LLP
If you agreed to pay these things then you cannot just stop paying. You will need to request to modify your current agreement which requires a hearing and having a judge change the order if they agree. You really should consult an attorney about your situation.

Can I take the marital settlement agreement to a family court attorney and try to get current help, even if I cannot get retroactive help?

You need to see an attorney ASAP! Any up front costs depend on the attorney. Florida has a doctrine called laches, means if you fail timely to assert a right the right is waived. You are probably safe due to your coma but do not wait. You might want to speak to your prior attorney as to why an Order was not submitted as to the retirement plan when the divorce was granted. There is no requirement to wait before sending the Order. Also you should have applied for social security disability benefits.

If one person is on the mortgage and pays the mortgage and another person is on the deed, who owns the house? How?

Answered by attorney John F Brennan (Unclaimed Profile)
Divorce lawyer at Musilli Brennan Associates, PLLC
The person who is on the deed he is the owner of the property, the person who has executed the mortgage note is liable for the note. Other than that I would need more details before I would render an opinion as to who actually controls the property.
