Can my husband kick me out of the house he owns if we are getting a divorce? How?

Answered by attorney Joanna Marie Mitchell (Unclaimed Profile)
Divorce lawyer at Joanna Mitchell & Associates, P.A.
No, he cannot kick you out of the house. If he has an interest in the house, so do you, even if your name is not on the deed or mortgage.

Do I need to return a portion of the sum if I will be remarrying?

Answered by attorney Anne Barbara Howard (Unclaimed Profile)
Divorce lawyer at Anne B. Howard, A Professional Law Corporation
You can remarry. He may ask you for some alimony back. Let him go to court and try to get it. He shouldn't have paid you a lump sum. Better not to spend it all just in case the court orders you to return part of it.

If I cash out a CD before I file for divorce can my spouse claim 1/2 in court?

default-avatar
Answered by attorney Mark Alan Brown (Unclaimed Profile)
Divorce lawyer at Wolfstone, Panchot & Bloch, P.S., Inc.
Under Washington state law, you can apply the CD monies as you determine appropriate. Keep an accounting of how the proceeds were spent in the event the husband make any claim for reimbursement. Incidentally, this illustrates the need to get the issues arising out of your separation and marriage resolved. Is the father even paying child support?
