Your rights to the marital property will be determined by the court in the divorce proceeding. If you do not live in the jurisdiction, make certain that you have properly responded in the court case, are receiving all court notices, and are responding timely to those notices. If not, would be concerned that your spouse may enter a judgment with the court against you by "default".

You can be divorced with out signing anything, but you run the risk of paying attorney fees. Just because you do not believe in divorce does not mean you cannot hire a lawyer to defend a divorce.

I would need more facts to form an opinion as there are a number of special circumstances that take this case out of the ordinary. You need a good attorney and a though review. I might appear to be costly but, given your position, an error will compound for years - if not for the rest of your life.
