You may file for divorce in Texas after living in Texas for six months. File in the county where you have lived at least 90 days. I am not sure what you mean about publicizing in the papers, but if you mean having the divorce citation served on him by publication, that is not available in cases where you know where he lives or could easily obtain that information.  You will need to have your husband served with the petition for divorce by a constable or process server.  Then your husband has an opportunity to respond to the suit.

There is a problem if you failed to obtain a divorce before marrying the second wife. You need to rectify this situation before filing for your second wife's paperwork. Hiding the first marriage or any form of misrepresentation on your immigration paperwork is a very bad idea. 1. Get a divorce from Wife one. 2. Then get remarried with Wife two. 3. Then you can start the immigration paperwork once one and two have been done.

You do in fact have certain rights and interests to the property even though you are not on the deed based on the minimal facts you provided. But at the very least, you are entitled to your very personal clothes, toiletries, and effects and I'm so sorry he has done that to you given your situation as it is! You should consult with an attorney as soon as possible to discuss immediate court intervention, possibly even some criminal measures if he is in fact harboring certain personal items that definitely would not be subject to property division.
