Can i request alimoney,if my husband abandoned the home and has a live in girlfriend now

Michael Todd Hampton
Answered by attorney Michael Todd Hampton (Unclaimed Profile)
Divorce lawyer at M. Todd Hampton, P.C.
you can always request alimony, and the court will consider all the circumstances such as his income and the conduct of both parties that led to the separation. there is no guarantee you would be entitled to it, but it sounds like you have a good argument. the question will be how much "other income" does he have. if you haven't already, a lawyer will help you file for divorce and request alimony from him. you can schedule a hearing in front of a judge to determine whether he will have to pay.

After you have lived in Georgia for six months, you can file for divorce here.  The only issue that would be addressed by the Court however would be the marriage itself.  Unless your husband were personally served here in Georgia, all other issues such as property or debt division, custody matters etc would not be adjudicated.

If me and my husband divorce do I have the right to get half the value of the house as her ex-wife did?

George Nebbie Seide
Answered by attorney George Nebbie Seide (Unclaimed Profile)
Divorce lawyer at Shulman Family Law Group
No, it is his separate property if still in his name alone. The community, of which you get half, gets a small ownership interest in the house, if payments came from his income (which is community property). It goes to the amount the principle balance of the mortgage is reduced. It is complicated.
