Can my soon to be "ex-husband" get married in Mexico if our divorce has not been finalized?

If you divorce is not final then he remains married to you. That being said I am not sure there is anything you can do about it if he lies there to get a marriage license.

You file in the county and state where you are a resident and have the other side served where he/she lives. Then you proceed in your state.

What do we need to do to vacate the legal separation judgement?

Answered by attorney Robert Andrew Michael Burns (Unclaimed Profile)
Divorce lawyer at Law Office of Robert Burns
Qualifying facts. You probably don't have them. You are still married. The judgment is misconceived by the learned geniuses of the legal profession who act like plumbers. The judgment is actually merely an adjudication of assets, liabilities, and community property rules. You remain married but without the application of community property rules; if you want those rules to apply as if you were newly married and/or never subject to the Judgment you should get a brief marital agreement so stating drafted by a family law attorney.
