If I file for divorce and he doesn’t respond, what will happen to the home?

Answered by attorney Mark T. Peters (Unclaimed Profile)
Divorce lawyer at Peters Law, PLLC
If you have equity in the home, you will probably have to pay him his half in order to keep the house. If you don't have any equity, i.e. it is underwater, then you might get him to agree to let you keep the house. Of course, you also have to take into consideration all of the other property and debts since in Idaho community property and community debt has to be shared equally.

No one who knows what they are doing would tender the proceeds of the sale without your signing off. However, there are persons without counsel.

You should file a divorce or legal separation case and request spousal support, attorneys fees, and for help paying the bills that the two of you accrued together.
