Yes ! Look at your marriage license - is the license issued in the correct name?  If it is you are fine.  If it is not, you can always correct the documents, but there really is no need.  Did you get a marriage certificate from the Court or religious ceremony?   As long as that certificate says the name you want it to, you are fine.

Do I have to file a motion with the court in order to stop alimony if there is a property settlement agreement in place

If you have it in your PSA and you are certain there is cohabitation for the required period, you could try to just stop alimony, but if a motion is filed against you, you will have to produce proof that there is cohabitation in order to defend against the motion.

Your girlfriend is already married and can't marry you until she divorces her first husband. If she's been in a state in the U.S for at least six months, she can get divorced in that state, or in a state where her husband has lived for the past six months. An annulment is probably out of the question, but it wouldn't hurt to ask about it when she sees a lawyer.
