What can I do if I own the house and wants my spouse to leave but he refuses to?

You can file for divorce and for exclusive use and possession of the house. However, a house is a trial issue, so the court will probably not order him to leave, but it's worth a try

Can we still get married? Or do I have to wait until he receives the paperwork if my fiancé has been divorced 1 year and couple months?

Divorce lawyer at Peters Law, PLLC
He doesn't need the divorce decree to get the license. However, it wouldn't hurt to call the court and get a certified copy of the decree sent to you. Maybe he isn't divorced and only thinks he is.

If a husband had a 401(k) for 8 years prior to the marriage, and the marriage only lasted 7 weeks, and ended via annulment, is the wife entitled?

My opinion would be that the annulment would preclude any award of interest in the 401(K), since the annulment make it as if the marriage never occurred. It would be worthwhile for you to consult with the attorney who represented you in the annulment to discuss this question.
