If a woman files for a divorce and leaves the home is this held against her? No children are involved.

Robert Lawrence Bogen
Answered by attorney Robert Lawrence Bogen (Unclaimed Profile)
Divorce lawyer at The Law Offices of Robert L. Bogen, P.A.
It will not be held against you if you file for divorce and leave the marital home.  Generally speaking, absent compelling circumstances to suggest otherwise, if the marital home is a marital asset, and there were no children of the marriage, then either one spouse will agree to buy out the other spouse's interest in the home, or one spouse will agree to accept compensating marital assets in return for the other spouse keeping the home, or the court will order that the home be sold and the proceeds divided.  You do not waive your interest in the marital home just because you moved out.

What legal step should I make if the state child support portal wants me to pay even if I already paid directly to my ex-wife?

Answered by attorney James Timothy Weiner (Unclaimed Profile)
Divorce lawyer at James T. Weiner, P.C.
begin paying through MISDU.. immediately contact them for instructions. Assert that you have always paid directly.. then File a motion in the court to confirm that in the future you will make all payments through MISDU and to show that you already paid all past. As a part of that motion ask for your child support amount to be re-evaluated due to your change in income. You could substantially cut your financial obligations.

What do I do if I get a letter to sign a qualified domestic relations order?

Answered by attorney Barbara Peyton (Unclaimed Profile)
Divorce lawyer at Peyton & Associates
You need to discuss it with an attorney show the attorney the letter and bring a copy of your divorce judgment to the appointment when you talk to the attorney. Usually the QDRO letter comes sometime after the divorce but you need an attorney to look at everything to be safe.
