If the prenup agreement is ruled to be valid and enforceable, whatever it says about what happens in divorce is what will happen and your "entitlements" will be limited to what the agreement says. You need to consult a lawyer in person to review the agreement and the circumstances under which it was prepared to find out if there are any legitimate reasons why the agreement should not be binding.

No, an inheritance is separate property. If you use the money for the purchase of something else that both of you will use and enjoy (like a house), then it becomes quasi-community (or partially community) property.

First, please be mindful of your personal safety and that of your child. It is of the utmost priority. Second, if you're still a legal resident in your home state, you may be able to file for divorce there based on your husband's continued residency in that state. However, if you intend to stay in Texas, you would be able to file for divorce here within six months of continuous residence in the state (with at least 3 months in the same county).
