What should I do in my divorce, husband sold my assets?

Bruce Provda
Answered by attorney Bruce Provda (Unclaimed Profile)
Divorce lawyer at Provda Law Firm
You should ask your attorney to make a motion in court for the return on the monetary value of these assets. This might also depend on whether or not your divorce is final and what your original agreement looked like.

Answered by attorney Eric K Johnson (Unclaimed Profile)
Divorce lawyer at Utah Family Law LC
In Utah, generally no.separate property owned prior to the marriage remained separate property in a divorce unless the spouse seeking a share of that property can prove to the court that the separate property was either made marital property by choice of the owner or that the separate property was "co-mingled" with marital property.

What do we need to take to a lawyer who will represent both parties?

Kristen Prata Browde
Answered by attorney Kristen Prata Browde (Unclaimed Profile)
Divorce lawyer at Browde Law, P.C.
A lawyer can not represent both parties in a divorce. That having been said if you present an outline of your agreement on all issues (economic division, custody and child support) a single attorney, representing one of you, can draw up the papers. It would always be prudent to have a second attorney (representing the other person) review the documents before filing.
