    Representative Cases: Kevin Kuhn has represented clients in more than 135 trials to verdict, including 80 jury
    55 bench trials. He has extensive experience defending high-stakes medical malpractice
    professional liability claims, in addition to catastrophic personal injury
    complex commercial litigation. Kevin is a Fellow of both the American College of Trial Lawyers
    the International Academy of Trial Lawyers.
    Won a complete defense jury verdict for a spinal surgeon in a multimillion-dollar medical malpractice lawsuit in Colorado. The patient, who suffered from acute spinal arthritis, experienced a complication during surgery that resulted in partial paralysis. WTO lawyers effectively demonstrated to the jury that our client was not at fault. Following the two-week trial, jurors delivered a complete defense verdict.
    Warden v. Exempla (Colo. App. 2014) - Won affirmation from the Colorado Court of Appeals in a defense verdict for WTO's labor
    delivery nurse client. Plaintiffs had claimed $17 million in this obstetrical malpractice claim.
    Won an appeal argued before the Colorado Supreme Court challenging a trial court's order to submit Quality Management Privileged (QMP) materials relating to an incident at issue in a medical malpractice trial. The appellate decision is significant, as the QMP designation allows hospitals
    healthcare providers to assess
    innovate following critical incidents without concern that their discussions will be discovered.
    Won a complete defense verdict in federal court in Colorado for an emergency physician in a three-week medical malpractice trial in which the plaintiff alleged misdiagnosis leading to paralysis
    asserted damage claims of $12 million. The verdict was featured in DRI's And the Defense Wins (October 1, 2014).
    Obtained victory before the Colorado Court of Appeals for a bariatric surgeon. WTO lawyers tried
    won the original case, which involved alleged complications following gastric bypass surgery. The Court of Appeals rejected the plaintiff's assertions that the lower court erred in precluding certain expert testimony
    affirmed the 2011 trial court verdict.
    Won a unanimous defense verdict for a labor
    delivery nurse in a $17 million, three-
    -a-half-week obstetrical malpractice trial in Colorado state court.
    Defended a trucking company against negligence claims arising from a nine-vehicle accident on a snowy Nebraska interstate highway.
    Won a jury defense verdict for a Colorado bariatric surgeon in Denver District Court.
    Ford v. Eicher (Colo. Sup. Ct. 2011) - Secured a l
    mark victory from the Colorado Supreme Court on behalf of the American College of Obstetricians
    Gynecologists in a case involving the reliability of the intrauterine forces theory of labor as applied in shoulder dystocia matters.
    Won a unanimous jury defense verdict for a cardiothoracic surgeon in a two-week medical malpractice trial involving injuries associated with an atrial fibrillation surgery.
    Won a jury defense verdict for an orthopedic spine surgeon in a medical malpractice case with millions of dollars in damage claims at stake, including eight years of accruing pretrial interest.
    Co-managed with one other law firm the response to requests from 418 dealers for arbitration relating to the bankruptcy of Chrysler Group LLC
    following Chrysler's termination of those dealerships. WTO litigated 187 of these Section 747 arbitrations,
    , as directed by Congress, resolved all of the litigation within seven months.
    Won a jury defense verdict in Denver District Court for a prominent Denver heart surgeon.
    Villalp
    o v. Denver Health, 181 P.3d 357 (Colo. App. 2007) - Won affirmation from the Colorado Court of Appeals for four doctors in a medical tort case involving wrongful death claims relating to medical treatment provided to the plaintiff's husb

Martindale-Hubbell® Client Review Ratings™ display reviews submitted by individuals who have either hired or consulted the lawyers or law firms.

The Client Review Rating score is determined through the aggregation of validated responses. People who submit reviews are either individuals who consulted with the lawyer/law firm or who hired the lawyer/law firm and want to share their experience of that lawyer or law firm with other potential clients. Reviewers can be anyone who consults or hires a lawyer including in-house counsel, corporate executives, small business owners, and private individuals.

Martindale-Hubbell validates that a reviewer is a person with a valid email address. As part of the review process, respondents must affirm that they have had an initial consultation, are currently a client or have been a client of the lawyer or law firm identified, although Martindale-Hubbell cannot confirm the lawyer/client relationship as it is often confidential. The content of the responses is entirely from reviewers.

Martindale Peer Reviews

Martindale-Hubbell® Peer Review Ratings™ are the gold standard in attorney ratings, and have been for more than a century. These ratings indicate attorneys who are widely respected by their peers for their ethical standards and legal expertise in a specific area of practice.

The Martindale-Hubbell Peer Review Ratings process is the gold standard due to its objectivity and comprehensiveness. Lawyers solicited for peer reviews include both those selected by the attorney being reviewed and lawyers independently selected by Martindale-Hubbell. All reviewers are verified as attorneys through Martindale-Hubbell’s extensive attorney database. Only attorneys practicing at least three years and receiving a sufficient number of reviews from non-affiliated attorneys are eligible to receive a Rating.

What are the different Martindale-Hubbell Peer Review Ratings?*

• AV Preeminent®: The highest peer rating standard. This rating signifies that a large number of the lawyer’s peers rank him or her at the highest level of professional excellence for their legal knowledge, communication skills and ethical standards.

• Distinguished: An excellent rating for a lawyer with some experience. This rating indicates the attorney is widely respected by their peers for high professional achievement and ethical standards.

• Notable: This rating indicates that the lawyer has been recognized by a large number of their peers for strong ethical standards.

Lawyers who have received peer reviews after 2009 will display more detailed information, including practice areas, summary ratings, detailed numeric ratings and written feedback (if available). Details for individual reviews received before 2009 are not displayed.

Attorneys that receive reviews from their peers, but not a sufficient number to establish a Martindale-Hubbell Peer Review Rating, will have those reviews display on our websites.
