Can I get my record expunged if I violated my probation with a felony charge? How?

No. There is a very short list of convictions that are eligible for expungement but assault and burglary are not on the list.

Is it legal to film someone without their knowledge in your residence that you are renting?

Answered by attorney John F Brennan (Unclaimed Profile)
Criminal Law lawyer at Musilli Brennan Associates, PLLC
I'm afraid I do not have enough facts in order to be able to provide you with a firm opinion. Generally persons are able to record or film anything which takes place in public, the question is whether or not you had a reasonable expectation of privacy if this was in your rented residence. Given the fact that this allegedly took place in up at a party, which is a pretty public activity, I suspect you do not have much of a complaint. As for your violating probation, that is unwise and can lead to significant trouble.

Does an officer have to write a ticket if a person is pulled over for speeding but additional charges are filed?

Answered by attorney Patrick Owen Earl
Criminal Law lawyer at Patrick O. Earl
No this is not a reason to drop the criminal matters that the officer believe was warranted in his/her investigation after the initial contact due to the speeding ticket. The infraction is the reason for the stop and contact and then if the officer can establish probable cause to continue with a crime investigation then anything else that is found within those guidelines are good to be charged. The argue on these type of cases is, "was the officer justified in changing his scope of the contact from speeding ticket to criminal investigation"? Talk to you attorney. If you don't have one get one.
